Answered plainly
A free zone can license your company. It cannot protect anything your company made.
Free zone marketing lists intellectual property protection among the reasons to set up here, as though the zone supplied it. It does not.
Every free zone in the country sells the same eight-line list, and one of the lines is intellectual property protection. It sits between the warehousing and the networking, phrased so that the protection sounds like something the zone hands over with the licence — a facility of the address, like the parking and the meeting rooms.
It is not. No free zone authority in the United Arab Emirates grants a trademark, a patent or a copyright, hears an objection to one, records a transfer of one, or acts on a complaint that somebody has infringed one. Three federal instruments do all of that, and one counter operates them.
Which of the three you need is decided by what the thing is, and that is the question this page answers: what a trademark, a patent and a copyright each protect in the UAE, how long each one runs, and which of them is not available to you at all. The prior question — where each of the things founders call "our intellectual property" actually lives, and the order to deal with them in — is mapped in your intellectual property sits outside the licence file.

The law that reaches over the fence
The Ministry of Economy and Tourism publishes its own summary of the three instruments, and the line worth reading twice sits under Federal Law No. (11) of 2021 on the Regulation and Protection of Industrial Property Rights. At the date of review (17 September 2026), the Ministry's description of that law states in terms that it applies to patents, industrial designs, integrated circuits, undisclosed information and utility models recorded in the country, including the free zones — and the scope article of the law itself says the same.
Read that scope line closely, because it is both narrower and stronger than it first looks. It is narrower in that it names a list of industrial property rights rather than making a blanket statement about everything a company owns. It is stronger in that it settles the free zone question by naming free zones, not by leaving them to be inferred from silence. Either way it inverts the marketing. The free zone is not a jurisdiction that supplies intellectual property protection; it is territory that a federal law reaches into. Whatever the zone did for your licence, your visas and your lease, it did nothing here, and it cannot.
The other two instruments are federal in exactly the same way, and the counter that operates them is the same counter: Federal Decree-Law No. (36) of 2021 on Trademarks and Federal Decree-Law No. (38) of 2021 on Copyrights and Neighbouring Rights, each with its own executive regulation — Cabinet Decision No. 57 of 2022 and Cabinet Decision No. 47 of 2022 respectively, with Cabinet Decision No. 6 of 2022 sitting under the industrial property law.
The practical consequence is that a company in Ajman and a company in the Dubai International Financial Centre hold identical rights and go to the identical counter, and that neither of them holds anything at all until it has been to that counter.
The Ministry's channels all act on an entry
Look at what the Ministry actually operates, because the shape of the service list is the whole argument. For trademarks there is a filing channel, an amendment channel, a renewal channel, an ownership transfer channel, an objection channel — for opposing somebody else's mark — and an infringement complaint channel. For industrial property there is a patent channel, a utility model channel, an industrial design channel, an integrated circuit layout design channel, an annuity fee channel and an Industrial Property Digital Library. For creative work there is an intellectual works channel, a channel for amending the certificate that channel issues, and a copyright infringement complaint channel.
Every one of those acts on an entry. Objection acts on somebody's entry, transfer moves an entry, renewal extends an entry, and the infringement complaint asserts an entry against somebody who has trespassed on it. A business that has never made an entry has nothing for any of these channels to act on — which is the answer to the question founders ask third, after they have discovered a competitor using their name. Copyright is the one partial exception on the protection side: the copyright law says a work loses none of its protection for never having been recorded, while making the Ministry's record the reference for a work and who owns it.

What you are protecting decides the instrument, and the wrong guess is expensive

The instrument is chosen by what the thing physically is, not by how valuable it feels or what the business calls it. The Official Portal of the UAE Government sets out the categories and the term each one runs for. At the date of review (17 September 2026), the terms below are the ones the Official Portal publishes, and the industrial property law states the same durations for patents, utility certificates, designs and layout designs. Laws and their executive regulations are amended from time to time, so read each number as the current position rather than a permanent one.

Software is the case where everyone guesses wrong
Half the companies licensed in this country's technology zones believe they will one day patent their platform. They will not, and it is worth being blunt about why.
The Official Portal's list of subject matter excluded from patentability names computer programmes outright, and it names them in the same item as schemes, rules and business methods. The rest of the list runs to plant and animal varieties and biological processes, methods of diagnosis, treatment and surgery, principles and discoveries and scientific theories and mathematical methods, natural materials subject to stated exceptions, and inventions whose exploitation would run contrary to public order or morality. Note what that first item means for a technology founder. The software and the business model are not two separate refusals to collect; they are the same line of the same list.
The protection that does exist for software is copyright, where software, smart device applications, databases and computer programs all appear among the protected categories by name. That is a materially different asset. It protects the expression that was written, not the idea that was had, and the Portal is explicit that ideas, procedures and methods are outside copyright as well. Which means the honest answer for most software businesses in a UAE free zone is that the code is protected, the concept is not, and the defensible part of the business will be the mark, the customer relationships and the speed — not a grant from the Ministry.

That also changes what a licence agreement has to do, because contract is carrying weight the statute is not.
The four occasions the question actually arrives, and is missed
At the trade name. The name your licensing authority approves is not a mark. It stops another company taking the same name with that same authority and gives you nothing against somebody using it commercially, a point set out in full under the setup decisions you cannot undo later. The trademark filing is a separate application, to a different body, on a different timetable, and the moment for it is while the name is being reserved.
At the first real contract. Who owns a work made by an employee, a contractor or an agency is settled by Federal Decree-Law No. (38) of 2021 and by what the contract says. Studios and agencies discover this at the point a client asserts ownership of something the studio assumed was its portfolio — the failure mode our Dubai Design District profile sets out for creative businesses specifically.
At the renewal nobody diarised. Rights lapse on clocks. At the date of review (17 September 2026), the Ministry's own description of the trademark law works from a ten-year period, an option to renew within six months after that period expires, and a further three months beyond that. The third of those is the one to read carefully: the Ministry's wording conditions the further three months on justifications it finds acceptable, which makes that window a discretionary application rather than a second entitlement. Diarise against the ten years and treat the six months as the recovery you may need. Do not build a plan on the three.
time counted from the day the ten-year period expires
the end of the ten-year periodthe line the clock crosses
Patents carry a separate problem. Among the Ministry's industrial property channels is one for paying an annuity fee, which tells you the cost of a granted patent does not stop at grant. When the first annuity falls due, and what non-payment does to a grant that has already issued, are fixed by the industrial property law and its executive regulation rather than by the service list — and they are the two questions to put to the Ministry before anyone treats a granted patent as an asset that looks after itself.
At the funding round or the group restructure. Where the intellectual property sits inside a group is a structuring question with a tax edge. Income from qualifying intellectual property is a narrow category — a point worked through on our Dubai Media City profile and under UAE corporate tax — and the marketing-related rights most consumer businesses own are outside it. Holding rights in a separate vehicle is a real structure, covered under ADGM and offshore company formation, and it is a decision about ownership, not about protection. Nothing about the holding vehicle files anything for you.

Where filing anything at all is the wrong purchase
Where the business will never be copied because there is nothing distinctive to copy. A trading company reselling somebody else's branded goods under a functional name owns no mark worth defending. Filing one is a fee, an agent's charge and an annual diary entry, in exchange for a right you will never assert. Spend it on the customs and logistics file instead, which is where that business actually breaks — customs codes and moving goods.
Where you are filing in the UAE and selling somewhere else. These instruments are UAE instruments. A mark protected here is protected here. A company whose customers are in Europe and whose UAE presence is a licence and a desk has bought protection in the market where it has the least to lose. File where the revenue and the infringers are. Two international routes are written into the instruments themselves. The trademark law recites the country's accession to the Madrid Protocol, and the Ministry's service list carries an international trademark application under it; the patent regulation provides for an international application under the Patent Cooperation Treaty to continue in the UAE as a national filing. Whether either route reaches the markets you actually sell into, and on what terms, is a question for the Ministry and for counsel in those markets. What does not change on either answer is the arithmetic: protection has to exist where the loss would happen.
Where the product will have changed beyond recognition before the grant issues. An industrial design on a first-generation enclosure, filed by a hardware startup that will redesign it twice before shipping, protects an object that will not exist. Novelty is a condition, and publishing the design before filing is the risk to ask about — but so is filing too early on the wrong version.
Where you are being sold intellectual property services alongside a formation package. These filings are not formation steps and they do not belong in a setup quotation. The Ministry maintains its own agent arrangements, including under Ministerial Decision No. (90) of 2024 for trademark agents. If a firm is invoicing you for a filing inside a licence package, ask which counter the application goes to and who is recorded as agent on it — the same question worth asking of every line, per choosing a UAE formation consultant.
What we would need before telling you whether any of this is worth doing
Three things, and none of them is your licence. What the distinctive asset actually is — a name, a body of work, a mechanism or an appearance. Which markets your customers are in, because that is where protection has to exist rather than where your desk is. And whether anyone outside the company has ever made part of the thing you believe you own.
For a large share of free zone companies the honest answer to all of it is a single trademark filing and nothing else, and we would rather say that before invoicing than after. What the zone does and does not do for you more broadly is set out under free zone company formation; what we can genuinely help with sits under business support.
Every instrument, category, exclusion and term described here is published by the Ministry of Economy and Tourism, on the Official Portal of the UAE Government or, for the tax point, by the Ministry of Finance, and was read there on 17 September 2026. Each is amended by its own authority without notice. Two points of housekeeping worth knowing while you look: the Ministry is now the Ministry of Economy and Tourism rather than the Ministry of Economy, and some of its own service links still sit on its former web address, so a link that fails is not evidence that a channel has closed. Confirm the position with the Ministry before relying on any of this.
Frequently asked questions
Does my free zone give me any intellectual property rights at all?
No. It gives you a licence, premises and an immigration file. The three instruments above are federal, the Ministry of Economy and Tourism operates every channel under them, and the Ministry's own summary of the industrial property law states that it applies to the rights it covers in the country, including the free zones.
Can I patent my app or my platform in the UAE?
Computer programmes are named among the exclusions from patentability on the Official Portal's list, in the same item as schemes, rules and business methods. Copyright protects the code as an expression; it does not protect the idea, the procedure or the method. The exclusion list sits in the industrial property law itself, with detail in its executive regulation, so confirm the current position with the Ministry of Economy and Tourism before building a strategy on either answer.
My trade name was approved by the free zone. Is the brand mine?
It is yours with that authority, against another company taking the same name there. It is not a mark and it is not protection against commercial use by anybody else. Those are separate filings at a separate counter. What the reservation itself gives you, and the grounds on which a name is refused before you ever reach the trademark question, is covered under trade name reservation in Dubai.
I found somebody using my name. What can I do?
The Ministry operates trademark and copyright infringement complaint channels. Both act on an entry, so the first question is whether one exists in your name — and if it does not, whether the other party has already made one. For copyright, a missing entry does not remove the protection itself; the copyright law says so, and it makes the Ministry's record the reference for who owns a work.
How long does protection last?
By category, and as at the date of review (17 September 2026). A patent runs 20 years from the application or international filing date and a utility certificate 10; the Official Portal states an industrial design at 20 years and an integrated circuit layout design at 10, the latter running from first commercial exploitation where that came first. For a trademark, the Ministry's own description of the trademark law works from a ten-year period, with the six-month renewal window running from its expiry and the discretionary further three months after that. Every one of those numbers sits in a law or regulation that can be amended, so confirm it with the Ministry before you diarise against it.
