Dubai Decides What Counts as a Health Activity. Your Website Copy Does Not.

Health and wellness is on every list of Dubai's open sectors, and the lists never mention that one sentence of Executive Council Resolution No. (49) of 2024 puts a second licensor between the idea and the first client.

The sector lists never mention the second licensor

Every list of Dubai's promising sectors carries health and wellness on it, usually described in the same two breaths: medical tourism is growing, and demand for good-quality care is high. Both of those things are probably true. Neither of them is a licensing statement, and the gap between the two is where the money goes.

Here is the gap, in one sentence. For most activities in Dubai, you obtain a licence from the Department of Economy and Tourism or from a free zone authority and you are trading. For a health facility, that licence is the first of two, and the second one is issued by a body that does not care what your business plan says.

That is not an inference from practice. It is written down, in an instrument most people setting up in this sector have never opened.

One sentence of Resolution No. (49) of 2024 does all the work

Executive Council Resolution No. (49) of 2024 regulates the practice of health professions and health activities in Dubai. It replaced a 2012 resolution, and Article 7 contains the provision that decides almost everything about how a wellness or clinical business gets built:

No natural or legal person may establish a facility to conduct Health Activities within the Emirate unless that facility is licensed by the Concerned Entities and has obtained a Licence from the DHA.

Take it apart, because each clause disposes of a common assumption.

"No natural or legal person." Sole practitioners are not outside it. A single therapist working alone is inside the same sentence as a hospital group.

"To conduct Health Activities." The trigger is the activity, not the entity type, the size, or what the business calls itself. More on that below, because it is the whole question.

"Licensed by the Concerned Entities." This is your economic licence — from the Department of Economy and Tourism on the mainland, from the zone authority in a free zone. Article 8 puts it plainly: the facility has to hold a valid licence from the Concerned Entities in the Emirate where it conducts its activities on a commercial basis.

"And has obtained a Licence from the DHA." And. Not or. Not and then, in due course. The economic licence permits you to exist as a business; the Dubai Health Authority Licence permits the facility to conduct the activity. A company holding only the first has a trade licence for something it may not lawfully do.

The second limb of the same article covers the people: no natural person may practise a Health Profession within the Emirate without a Licence. Facilities and practitioners are two separate populations of applications, and the facility being licensed does not license anybody inside it.

"Health Activity" is a defined term, and the definition does not mention you

This is the part that catches wellness businesses specifically, and it catches them because founders assume the boundary is drawn by vocabulary.

The resolution defines a Health Activity as any of the activities approved by the DHA relating to preventive, therapeutic and convalescent healthcare services provided to patients. Read that twice. The definition is not a list of medical words you can check yourself against. It is a delegation: the authority maintains the set, and membership of the set is determined there.

So the test is not whether you describe the service as a treatment or as an experience. It is not whether the room is called a clinic or a studio. It is not whether the person delivering it holds a foreign clinical qualification or none. The question a founder actually has to answer is narrower and harder: is what we intend to do, on the DHA's own list of approved Health Activities?

Two consequences follow, and they run in opposite directions.

The first is that plenty of businesses trading on health language are outside the regime entirely. A gym, a barbershop, a salon offering cosmetic services, a shop selling supplements — these sit with different permitting bodies. Salons, barbershops and beauty centres are permitted by Dubai Municipality's Health and Safety Department, which publishes its own technical guidelines for them; wellness products are a separate question again, closer to the conformity work described on our product setup page than to anything the DHA does.

The second is that the boundary is not where the marketing sits. The preventive limb of the definition is the one people underestimate — "preventive" is in the text alongside therapeutic and convalescent, and a service can be entirely preventive and entirely inside the regime. Anything that moves from grooming or relaxation toward diagnosis, injection, prescription, or the treatment of a condition is walking toward the line, and it is the authority's classification that says where the line fell, not yours.

The honest advice here is unglamorous. Before the premises, before the brand, before the fit-out: get the specific service list in front of the DHA and find out which side of the definition each item falls on. That is a cheap question asked early and a catastrophic one asked after a lease is signed.

the activity decides, not the vocabulary

  • Diagnosis, injection, prescription, or the treatment of a conditionIt is walking toward the line, and the authority says where the line fell
  • A service that is entirely preventivePreventive sits in the definition alongside therapeutic and convalescent
  • Whatever is on the DHA's own approved set, whatever the room is calledThe definition delegates the set to the authority instead of listing medical words

Inside the DHA regime

  • A salon offering cosmetic services, a barbershop, a beauty centreIts Health and Safety Department permits them and publishes their technical guidelines

Dubai Municipality

  • A gym, or a shop selling supplementsTrading on health language, and outside the regime entirely

A different permitting body

  • Wellness products rather than servicesCloser to product work than to anything the DHA does

A conformity question

The free zone does not move the boundary

The reflex, once people discover a regulator, is to look for a jurisdiction without one. Resolution No. (49) of 2024 closes that door in its scope article.

Article 2 applies the resolution across the Emirate including special development zones and free zones, and names the DIFC among them. Government and private facilities are both covered, along with the professionals practising in them; the carve-outs run the other way, toward federal government entities and toward the penalty treatment of government bodies, not toward commercial operators looking for a lighter regime.

This is the same pattern set out in the activities a second authority has to approve: a zone authority licenses, it does not regulate the sector, and choosing a zone changes who issues your economic licence without changing who approves the activity. What a zone can change is whether it will issue the activity line at all — which is a real and separate question, and one worth asking before any deposit moves.

For the district actually built around this sector, with its own history and its own arrangements, see our Dubai Healthcare City profile. But do not read a sector free zone as an exemption. It is a location.

The diamond is the only step in that sequence that costs nothing and decides everything. It is also the only one most people skip.

A man in a kandura reads a sheet while a standing woman sets down papers and a colleague works

The people are a second project, running on a different clock

A founder who has budgeted for a facility licence has usually budgeted for one thing. There are two, and the second one is a queue of individual applications, each attached to a named human being with their own documents, their own qualifications to be assessed, and their own timeline.

Article 12 sets the terms: a standard licence running one year and renewable, a multi-year term of up to three years, and a Temporary Licence to Practise valid for a period not exceeding six months — the instrument that matters if part of your model is visiting practitioners rather than resident ones.

Two things follow that are almost never priced into a setup quotation.

Recruitment is a licensing dependency, not a staffing one. A clinician you have hired is not a clinician who may work. The facility cannot open its doors on the strength of its own Licence if nobody inside it is licensed to see anyone.

A named individual leaving is a regulatory event. The resolution treats a change of medical director as a chargeable, notified change, and penalises failure to appoint replacements. That is the same exposure flagged generally in the activities a second authority has to approve — where an approval rests on a specific qualified person, the approval is exposed to that person's resignation letter.

If your model depends on one exceptional practitioner, understand that the regulator has a relationship with that practitioner and not with your recruitment strategy.

You may not promote it before you may provide it

The resolution defines Health Promotion as the dissemination of information or data, through any print, audio, visual or electronic means, for the purpose of promoting healthcare services — and it treats promoting without authorisation as a violation in its own right.

The practical failure this creates is a sequencing one, and it is extremely common. A business builds the website, opens the social accounts and starts advertising while the facility Licence is still in process, on the reasonable-sounding theory that marketing has to warm up before opening. In this sector that theory is wrong. The promotion is itself regulated, and doing it early is not a head start; it is a separate exposure while you are least able to absorb one.

Penalties under the resolution run to fines with suspension, revocation and closure available alongside them — and the ranges published for facilities are materially higher than for individuals, with repeat violations within a year treated more severely. Confirm the current figures before relying on any of them; the point that survives any amendment is that the enforcement is against the facility and against the person, separately.

The federal law is the wrong instrument to read if you are in Dubai

A woman reads a crested document while a stethoscope rests on ring binders and a man in a kandura watches

One warning, because the internet is full of this mistake and it produces confident, wrong answers.

There is a federal regime — Federal Law No. (4) of 2015 Concerning Private Health Facilities, with executive regulations issued by Cabinet Resolution No. (29) of 2020 — and Article 6 of those regulations contains an ownership condition tying ownership of a private health facility to UAE nationals, subject to exceptions for larger and specialised hospitals, rare specialisation centres, and clinics operating inside hotels, schools and construction companies.

That provision circulates widely, stripped of its context, as though it described the position for any clinic anywhere in the country. Dubai has its own health authority and its own instrument, and this page rests on the Dubai instrument. Whether the federal ownership condition has any application to a facility licensed by the DHA is a question to put to the DHA before it is answered — and it is not answered here, deliberately. The general point about which licence follows which border is set out in your licence is an emirate licence, not a UAE one.

Read the instrument that governs your emirate. A federal article quoted at you by someone selling a setup package is not a substitute for it.

Where health and wellness is the wrong sector to buy into

If the appeal was that it is a "growing sector". Growth is a market fact and licensing is a legal one, and they do not negotiate with each other. A crowded, slow, twice-licensed sector with strong demand is still a crowded, slow, twice-licensed sector. If the reason you are looking at this is that somebody's list of Dubai opportunities put it at number five, that is not a reason.

If your timeline cannot absorb a second authority. The setup clock in this sector does not start when you pay a consultancy — it starts, as the setup clock starts at a complete file explains, when a complete file reaches the counter, and here there are two counters plus one per practitioner. A founder who needs revenue in ninety days should choose a different activity rather than compress this one.

If you have no clinical governance and no intention of building any. The regime is constructed around a named medical director, licensed individuals and inspection. If the plan is to hire practitioners and stay out of the clinical side, understand that the regulator will not accept that division. The liability does not delegate — the same point made in delegating the work does not delegate the liability.

If the business is genuinely a salon, a gym or a shop. Then it is one, and it should be licensed as one. Reaching for clinical-sounding services to raise the price of a treatment menu is the single most reliable way to move a simple municipal permit into a regime with inspections and closure powers. Some businesses should stay on the non-clinical side of the line on purpose.

If you were sold a "wellness centre licence" as a package. There is no single product with that name. There is an economic licence, there is a determination about whether your services are Health Activities, and there may then be a facility Licence and a set of individual practitioner Licences. Anyone quoting one price for all of it before the determination has been made is quoting for an unknown. The vetting questions are in choosing a UAE formation consultant.

If the real plan is medical tourism and nothing else is in place. Inbound patients are the output of a licensed facility with credentialled clinicians, accreditation, referral relationships and insurance arrangements. It is a distribution strategy layered on top of a fully built clinical business. It is not an entry route into one.

What we would need in order to tell you which regime you are in

Three things, and none of them is a business plan: the exact list of services you intend to deliver, written out one line at a time rather than summarised; whether any of them involves diagnosis, injection, prescription or the treatment of a condition; and whether the people delivering them hold clinical qualifications and where those qualifications were awarded.

Those answers place a business on one side of the Health Activity definition or the other, and that placement drives everything downstream — which authority, how long, how many applications, and whether the premises you are looking at can ever be fitted out for it.

Every provision described here comes from the instruments named above, each of which is amended by its own authority without notice. Confirm the current position with the Dubai Health Authority and your licensing authority before relying on any of it.

Tell us what you actually intend to do to a client, in plain words, and our business support team will tell you which counters that puts you in front of — including, often enough, only one.

Frequently asked questions

Does a wellness centre need a DHA Licence?

It depends entirely on whether any of its services fall within the DHA's approved Health Activities. The name over the door is irrelevant to that question, because the resolution defines a Health Activity by reference to the authority's own approved set rather than by any vocabulary you can check yourself against. Put your intended service list to the authority before signing a lease, because the answer determines both your cost base and your timeline.

Can I avoid the health regulator by licensing in a free zone?

No. Article 2 of Executive Council Resolution No. (49) of 2024 applies the regime across the Emirate including special development zones and free zones, and names the DIFC among them. The zone changes who issues your economic licence. It does not change who approves the activity. What a zone can decide is whether it will issue the activity line at all, which is worth asking before any deposit moves.

Is the facility Licence enough to start seeing clients?

No. The facility and each practitioner are licensed separately, so a facility Licence with no licensed practitioners inside it permits nothing useful. Article 7 licenses the premises to conduct the activity; its second limb licenses each natural person to practise. That makes recruitment a licensing dependency rather than a staffing one, and it makes a queue of individual applications part of the opening timeline rather than an afterthought.

Can I start marketing while the licence is in process?

Treat that as unsafe. The resolution defines Health Promotion as disseminating information to promote healthcare services through any print, audio, visual or electronic means, and treats promoting without authorisation as a violation in its own right. Establish what authorisation your promotion needs before the first post goes out, not after — building the website and the social accounts early is a separate exposure, not a head start.

I read that a private health facility must be owned by a UAE national. Is that true in Dubai?

That condition comes from the executive regulations of the federal private health facilities law, which is a different instrument from the one governing a DHA-licensed facility in Dubai. Do not act on it either way without putting the question directly to the DHA for your specific facility type. Whether it reaches a DHA-licensed facility at all is a question this page deliberately leaves to the authority.
